GOLDWATER INSTITUTE SUES NORTH DAKOTA BAR ASSOCIATION FOR VIOLATING FIRST AMENDMENT RIGHTS OF LOCAL ATTORNEYS

Bismarck—Today the Goldwater Institute sued officials at the State Bar Association of North Dakota for violating the First Amendment rights of Bismarck attorney Arnold Fleck by failing to follow U.S. Supreme Court-required safeguards on using member dues for political purposes.

In 2014 the Bar Association gave $50,000 to a political committee organized to defeat Measure 6, the North Dakota Parental Rights Initiative. In doing so, it violated U.S. Supreme Court-mandated safeguards that govern how bar associations are allowed to use mandatory member dues to engage in political activity

Are Grandparents Obligated to Pay Child Support?

‘A recent California case reiterated what is the law in all states, and is, indeed, the public policy of the federal government as evidence by the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, Pub. L. No. 104-193, 110 Stat. 2105: “A child’s right to support is owed by a child’s parents, not the state.” City and County of San Francisco v. Garnett, 70 Cal. App. 4th 845, 82 Cal. Rptr. 2d 924, 928 (1999). This statement can be taken one step farther: “A child’s right to support is owed by anyone the government can somehow make pay, not the state.”

Bill could hook grandparents for child support

HB128 would hold parents of a minor who has a baby financially responsible for their grandchild.

The state’s Child Support Enforcement Agency would be able to seek child support from both sets of grandparents.
